TERMS AND CONDITIONS OF USE OF THE SERVICES PROVIDED BY BB Media
1. Contents
The service space provided by BB Media may only be used for lawful purposes. Using the services provided to store, present, transmit of any kind of information, data or material in violation with the United States Federal, State, City or any European Union laws is strictly prohibited. Case 1: The subscriber has subscribed to the web hosting services which are targeted and designed for business, personal and any other non comercial type of hosting and the contents of the web sites or does not include materials such as:
Copyrighted material
Material that is threatening or obscene
Material that is 'adult only content' or also classified as pornographic *
Material protected by trade secrets and other statue
WAREZ Software or not licensed MP3 files
Spamming software
Will be deleted of the servers immediately and closure of accounts will occur without prior notice to subscriber. The subscriber hereby agrees keeping harmless materials and to take responsibility for whatever stored on his space provided by BB Media. In case of any claims resulting from the use of the service which damages other subscribers or any other party, legal action against the subscriber might be taken from the authorities or any other authorized institution leaving BB Media not responsible for their actions * Note: Pornography and sex-related merchandising, illegal activity promotion or content that might be damaging to servers operated by us or any other party are prohibited on any server owned or operated by BB Media. Links to such materials are also strictly prohibited. BB Media will be closing accounts that are containing any of the mentioned materials without giving prior notice to subscribers or any refunds due to a closure of account for such contents. Case 2: The subscriber has subscribed to the services specialy designed and targeting adult hosting, e-commerce hosting and any other commercial type of hosting and the contents of the web sites or does not include materials such as:
Copyrighted material
Material that is threatening or obscene Material that is 'adult only content' or also classified as pornographic ** Material protected by trade secrets and other statue WAREZ Software or not licensed MP3 files Spamming software will be deleted of the servers immediately and closure of accounts will occur without prior notice to subscriber. BB Media will be closing accounts that are containing any of the mentioned materials without giving prior notice to subscribers or any refunds due to a closure of account for such contents. Nudity content might be published although the following rules must be strictly followed: No child pornography must be placed on any of the servers or web space provided. All models involved must be at the age of 18 or over. Disclaimer at the begining of the site containing nudity is provided to users and clear explanation of the content of the mentioned site is given. *** Note: BB Media provides unlimited web server space in respect with all international laws. Materials that are found to be illegal, will be deleted and BB Media must not be held responsible for any of its customers actions.
2. Refunds
BB Media is operating a 14 days money back guarantee in case our customers are not satisfied for any reasons with the services provided by us. To cancel your account please contacts our sales team via our Ticketing System provided in the control panel of your hosting account or direct via e-mail and we will refund your full payment. Please note that if any charges are involved into the refund (e.g. Credit Card charge by Card issuer, PayPal or Western Union Charge etc.) this will be deducted from the money refunded. Customers will receive a full list with description of the charges applied to the amount (if any) that has been refunded by e-mail.
2.1 Special cases & Domain names
Please note that each domain name ordered with the hosting account costs less than if purchased separately. For full domain name price list, please visit yepsy.com. All domain names are not refundable due to registrar's policy. The total cost of any domain names that have been purchased together with the hosting account and are free or partially covered by the customer must be deducted from the money refunded. Domain accounts are not locked and can be freely transferred to your new provider. To do so, please contact our support team via the Ticketing System located in your control panel or by email.
3. Traffic
Each individual packet comes with traffic allowance per month. This traffic allowance is considered upload/download from your web site. When the allowed transfer is used the site is subject to suspension. Users that go over the allowed free traffic will be charged $ 2 per extra gig that will have to be obtained manually from BB Media.
4. Support
BB Media does not provide Support over the phone to minimize the cost of service. We only provide on-line support via our Ticketing System, which is located in each user's Control Panel under the section named "Support" or alternatively via E-mail. The Support Team will try and help each user with any problems related to their web hosting account, but the Support Team is not entitled to run, develop or have any interference with the users' web site.
E-mail Support
Answers regarding a certain account will only be sent to the email that is associated with this account, so it is the user's duty to make sure the email associated with their account is up to date by clicking and updating the "Details" section in the Control Panel. If password is requested, we are only going to provide it after the user has answered the secret question associated with the account. PLEASE USE AN ALTERNATIVE EMAIL ADDRESS FOR YOUR ACCOUNT HELD IN THE SYSTEM AS IF THERE IS ANY MAJOR PROBLEM WITH YOUR ACCOUNT AND YOU CANNOT LOG-IN TO THE CONTROL PANEL, THIS IS THE ONLY MEANS OF COMMUNICATION BETWEEN YOU AND THE SUPPORT TEAM.
5. SPAM and E-mail
Spamming on BB Media servers is strictly not allowed. Any users found to be abusing the system by sending junk e-mails of any sort without prior warning are subject to cancellation without refund and BB Media reserves the right to disable your domain without prior notice. Services to known spammers will be refused directly byBB Media. BB Media' network, equipment or any e-mail provided by us must not be used in connection with the transmission of spam, flames, mail bombs, or substantially similar, unsolicited email messages. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. This prohibition extends to the sending of unsolicited mass mailings from another service that in any way implicates the use of the BB Media' network, equipment or email address. A message is considered unsolicited if it is posted in violation of a newsgroup charter or if it is sent to a recipient who has not requested or invited the message. For purposes of this provision, merely making one's email address accessible to the public will not constitute a request or invitation to receive messages. Any violation will result in immediate deactivation of services without refund.
6. Intellectual property rights
Some information contained on any of BB Media servers may be subject to protection under the United States or other copyright laws of the European Union or any other copyright laws, or laws protecting trademarks, trade secrets or proprietary information. If not permitted in a written form you must not use BB Media services in a way that would break any of the mentioned above legal rights. If you use a domain name in connection with the BB Media service, you must not use that domain name in violation of any trademark, service mark, or similar rights of any third party.
7. Hacking - network rules
Hacking, breaking in, sniffing or any attempt of users to circumvent user authentication or security of any host, network, or account is strictly not allowed using BB Media services. This includes but is not limited to accessing data initially not addressed to customers, password cracking, entering other subscribers accounts without their written permission, attempts to overtake other networks via their weakness point, installing software that might damage the servers owned by BB Media. Users are not allowed to interfere or deny service to other subscribers, hosts, networks via mail bombing, flooding or any other attempts to shut down, slow down, overload or crash a network or a specific host. BB Media will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. Users who violate system or network security may incur criminal or civil liability. Accounts to such users will be automatically stopped and they will be subject to no refund.
8. Not following Service Rules
BB Media reserves the right at its sole discretion to refuse or cancel service. Violation of any of BB Media Rules and Regulations could result in a warning, suspension, or possible account termination. Accounts terminated due to policy violations will not be refunded.
9. Disclaimer
BB Media will not take any responsibilities for any damages on your business due to the use of our services. BB Media does not give any warranties, expressed or implied for services provided. BB Media disclaims any warranty or merchantability or fitness for a particular purpose. This includes any loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions that might be caused by BB Media and its employees. BB Media keeps the right to amend or update these policies and its services without notice at any time. Failure to follow any terms and conditions mentioned on BB Media web site may result in account deactivation without refund. BB Media expects that resellers who provide services to third party users will fully comply with all applicable laws concerning the privacy of online communications. A customer's / reseller's failure to comply with those laws will violate this policy. Any legal claims against ITA Network Solutions resulting from violation of any law by a subscriber or reseller and any damages awarded against ITA Network Solutions, plus costs and reasonable attorney's fees will be paid by the subscriber or reseller responsible. If any terms or conditions are failed to be followed it will result in grounds for immediate account deactivation.
